Attorney Review of Closing Documents.

Helping lenders meet the statutory obligations to make sure their loan packages are compliant with Texas law.

Section 83.001 of the Texas Government Code requires that documents relating to the transfer of real estate –including mortgages –be prepared or reviewed by a Texas licensed attorney. To make sure our clients meet this requirement, we provide a simplied process that works best for what the lender needs.

Review of Current Loan Package

For new clients, we always like to review the current loan package to make sure it is compliant and contains any state specific forms required in Texas. We then take our process to what works best for our clients. We accept orders via email, delivery from LOS system, or even obtaining loans directly from the lenders LOS.

Title Work & Survey

In addition to a review of the closing package, we also review the title work and survey.

Document Preparation of Closing Packages:

Don W. Ledbetter, PLLC can generate a Texas compliant closing package if a lender would prefer we prepare the closing documents.

We can do a complete input from scratch or we have interfaces with several LOS systems available to where the loan data is transferred to our doc system.This process also includes a review of the title work and the survey.

Construction and Commercial Loan Document Preparation

We advise banks and mortgage companies on residential new construction and home improvement loans of all sizes and types secured by Texas properties. We draft and negotiate the loan documentation required for such transactions including the construction loan agreement and mechanics lien documents that are required for these residential construction projects.

We also draft several types of commercial/business purpose loans for our bank clients including contract and speculative residential construction loans for builders and land development loans along with purchase money loans or refinances of rental properties. We draft loan packages for the construction of commercial buildings along with handling the loan documentation for the purchase or refinance of loans secured by liens against commercial real estate. When the borrower is represented by counsel in any of the above referenced transactions, we handle any negotiation of the terms of the loan documentation on behalf of the lender.

Ancillary Documents

We are also able to prepare other misc documents connected to real estate transactions such as warranty deeds, lien releases, subordination agreements, modifications, power of attorneys, trust reviews and other misc documents.
